Arizona Rules of Civil Procedure

You generally have 180 days from the date that the negligent action occurred against you to file a claim against a public employee, according to the Arizona rules of civil procedure. The claim needs to have several components, including facts that allow the public employee to understand the case against them, a specified monetary amount for which the case can be settled, reasons for the specified amount, and a couple other sections as well. In addition, the 180 days starts from the date that the cause of action accrues, which means it starts from the date that you realize or should reasonably realize what or who caused the damage against you.

Don't hesitate to discuss your case with our firm. Call (602) 483-6114.

There are many other relevant sections and laws regarding filing suits and claims against government employees, all of which a competent attorney should have a comprehensive understanding of. For example, the Federal Tort Claims Act also allows individuals to file a civil lawsuit against the government for negligence committed against them by government employees. Our knowledgeable attorneys in Phoenix have handled countless cases against the government and know all of the available laws and policies we can use to support your claim.

Several other significant sections of the Arizona rules of civil procedure include:

  • An incompetent, insane, or minor individual may file a claim against the government within 180 days after their disability ends
  • Any claim not filed within 180 days after the cause of action accrued is deemed invalid and is barred from proceeding
  • The claim against the employee is considered denied if 60 days have passed after the filing unless the claimant has been informed of their denial in writing before 60 days have passed.
